Die Anwälte von Eldrick Tont Woods haben in Großbritannien eine einstweilige Verfügung erwirkt, die die Veröffentlichung von Nacktfotos ihres Klienten unter Strafandrohung unterbinden soll. Im an die Öffentlichkeit geratenen Dokument findet sich dieses Juwel juristischer Argumentation:
“For an avoidance of doubt this Order is not to be taken as an admission that any such photographs exist, and in the event that these photographs do exist, and it is not admitted, any such images may have been fabricated, altered, manipulated and or changed to create the false appearance and impression that they are nude photographs of our client. Our client is not aware of any images and in any event he would not have consented to any such photographs being taken nor would he have consented to the dissemination and exploitation of the same.” (Tiger Woods injunction – pdf)
Also: es gibt keine Nackfotos; wenn es welche gäbe, wären sie gefälscht oder manipuliert. Gäbe es – was unser Klient bestreitet – echte Fotos, hätte unser Klient ihrer Erstellung nicht zugestimmt. Selbst wenn er ihrer Erstellung zugestimmt hätte, hätte er der Verbreitung der Nacktfotos nicht zugestimmt. Eine Veröffentlichung der gefälschten oder echten (aber sowieso nicht-existenten) Nacktfotos durch wen auch immer ist daher gerichtlich untersagt.
